Today on my show, I asked constitutional scholar Judge Andrew Napolitano (Fox News Judicial Analyst) what he thinks of the detainee bill the Senate passed yesterday. He doesn't like it at all, and says it will not stand up to scrutiny by the Supreme Court. That won't stop it from being used for political purposes in the next six weeks, of course.
